Our client, a citizen of India, had his H-4 I-539 application denied by USCIS. Attorney Furqan filed a “nunc pro tunc” (NPT) I-539 for him, despite that his I-94 had expired. It was filed on the basis that he was a minor, his parents were in status, and that he was attending school. USCIS approved the case without an RFE.
