Our client is a multinational company with offices in the US, India and Chile. The beneficiary was working in the Chilean office for over 1 year and was seeking to return to the US on an L-1A. The problem was that the Chilean office had no centralized work location, and less than 10 W-2 employees. Attorney Furqan argued that the beneficiary was a “Functional Manager” and therefore the number of employees he managed was not as important as the work that he was doing for the company. USCIS approved the case in PP without an RFE.
