Iraqi National with Harboring Conviction Allowed to Keep Permanent Residency

Our client, an Iraqi national, came to the US in the early 1990’s. In 2001, he was convicted of Harboring a Fugitive and thereafter placed in deportation proceedings. DHS/ICE argued that he had been convicted of an aggravated felony, but Attorney Furqan argued to the immigration judge that he should be allowed to keep his permanent residency because the conviction did not fall within the federal harboring statute, and that if he was deported back to Iraq, his 5 children would suffer extreme hardship without him. The immigration judge agreed with Attorney Furqan’s arguments and allowed our client to keep his permanent residency.
